my daughter is 5 and i had here when I was 15 the guy i had her with was a big jerk whatever then i started dating a guy and we have been together since I am 22 now and married to this guy and he has been her dad since she was born and since we got married i was wondering how you just change the last name he will adopt her soon but i wanted her name changed at least before school starts which is soon. so how abouts do i do thisHow do you change your childs last name to yours?If the adoption is already in process, just explain to the school that your daughter's name is ____ but will soon legally be ____ as your husband is adopting your child.



I went through a very similar thing. When my oldest was starting Kindergarten, we were in the process of having my husband adopt her. I explained it to the school and the principal was a major *** and refused to cooperate. However, my lawyer (who has done many adoptions) had never seen such a case before as most schools cooperate very nicely. The next year, our principal was fired mid-year. So he had other issues, too.



If you are just wanting to change her name, but your husband hasn't adopted her yet, you will need to go through court and will have to have the exes ok on it, unfortunately.

It depends on where you live. Some its a quite simple process only needing to go to your town building. Some places your husband will need to adopt her first and/or get her father's permission in order to do anything. Best to call first and see what the regulations are for where you live.

in most states you do NOT have to have the fathers permission. I know that here I can have my daughters name changed to match mine, the cost here is $60, and I have to go b4 a judge and give the court my reasons for wanting the change. Her father has visitation, no custody, and there is an option to get his permission, but the court can over rule if he should fight it. In our case my daughter has my maiden name, not his, and her name will change once I remarry next year. We went ahead and got all the info so that we would be ready and everything will happen smoothly. In out state, I went to the courthouse, to the same window where you pay court costs, etc, and picked up the forms...there are 2 pages, once those are turned in I receive an appt with a judge, and go b4 him/her to petition the change. They give a ruling, I pay the court fees, and all of her paper work gets changed over. It takes a few weeks at most to get it all straightened out, but its worth it!
If the father has any custody at all it will be nearly impossible, he probably won't go for it. If the father has had ZERO contact with her all her life then you could go to the courts and petition for an adoption, but depending on the state, the ACTUAL father has to give his permission for another man to adopt their own child.



It's not just filing a piece a paper, it's going in front of a judge and hearing your case. Best thing to do? Hire an attorney.
I was in the same situation and I changed my 2 children's last name to match mine and my husbands. You have to go to court and get a name change packet of a minor..it only costs a few bucks. Fill it out, (you might want to get a professional to help you because its a lot of paperwork and legal terms) and then take it back to the court house to file it. That cost us $255.00. It took about 6 weeks after filing before we went to court and then another 4 weeks for the final judgment. Good luck!
Probate family couthouse...fill out the necesary documentation. Just go and they'll let you know what is needed to get the process started.
I know here you would have to go to the courthouse and see the town clerk. It would be the same place you would go to get copies of her birth certificate. I'm not sure how difficult it is, but I know around here, it's not cheap!

You have to have the consent of the birth father and you have to go to court. I would just wait until your husband addopts her as it is a huge hassle
im sorry but im not too sure that her name can change.yours can since you remarried but since the guy u had her with is her real father shes gonna have his last name.
