How do you solve name infringement with no copywrite?

Im in a school click called the nell'Emilia Family. We are one of the five Families at my school. It is like a company, cept it is a shadow group dealing with food scams, gambling, security guard payoffs, protection rackets, and the sale of candy which is banned now, since its illegal to sale independently outside of the vendor machines. Infact, our very existance is against the rules. That means we obviously cant copywrite our name. We found out that at another school in the burbs, there is another nell'Emilia Family. As consigliere I attended a meeting in which they refused to change names. Tony (the boss) says we can just buy them out or take over. The first thing that you need to know is that names are not copyrighted. Trade names are protected by registering them as trademarks... ever notice a little %26quot;TM%26quot; after a brand name? That indicates that it's a registered trademark.



The first one to register a trademark gets exclusive use of it within that area of business--thus the famous settlement that allowed Apple Computers to use their name as long as they stayed out of the business of recorded music and why it was a big deal when they started iTunes up.



In your case, since no one has registered the trademark, anyone can use it. Until one of you registers it, neither has the right to stop the other from using the name.



So what, are you writing a script or what? If so, I deserve a consulting fee.
